U.S. Supreme Court Refuses
Chevron Challenge of Ecuador Damages
The U.S. Supreme Court has
refused to hear Chevron Corp.’s challenge of an $18.2 billion judgment issued by an Ecuadorian court over large-scale damages caused by oil drilling in the Amazon. The Supreme Court decision is the latest development in a long legal battle that led to a ruling last year by an Ecuadorean court that Chevron had to pay the damages for massive oil dumping by Texaco, which Chevron acquired in 2001. Chevron was challenging a ruling by the 2nd U.S. Circuit Court of Appeals in New York that would have effectively opened the way for worldwide enforcement of the judgment against Chevron. An Ecuadorean court found that an oil consortium run by Texaco
dumped billions of gallons of oil and toxic sludge in the Amazon rainforest from 1964 through 1992, badly polluting water supplies and causing health problems among some of the 30,000 plaintiffs in the Lago Ario region. Chevron vowed to continue to fight the Ecuadorean court’s decision, which it called “fraudulent” and tainted by judicial misconduct. Chevron contends that the decision is not enforceable under New York law. Lawyers hired by the plaintiffs have recently filed seizure actions targeting billions of dollars of Chevron assets in Canada and Brazil.
